The Benefits of Dispute Escalation Paths

In the 24 September 2009 edition of Supply Management magazine, the official journal of the Chartered Institute of Purchasing and Supply (CIPS), CMD Director Paul Carter Hemlin has had an article published on the merits of drafting Dispute Escalation Paths into contracts.

A Dispute Escalation Path is a mechanism that allows each tier of two contracting parties' management teams the opportunity to resolve a dispute before it is escalated up the organisation. Each step of the process must have a clearly defined timescale and output.

Paul has been a Member of the Chartered Institute of Arbitrators for over 10 years and has experience of numerous contractual disputes. In the article Paul says "when two parties fall out they will be unable to agree that Christmas falls on the 25 December, let alone agree on how they should resolve a dispute. Suggestions to move forward will be treated with suspicion by the opposing party, assuming some kind of hidden advantage or agenda for choosing one resolution process or another. However, if the contract already deals with this eventuality and they adhere to the process - which they are bound to do - they will be part way to resolving the issue without needing to call the lawyers and commence expensive formal dispute resolution such as arbitration or litigation."
