From the moment the deal is signed you and your trading partners have legal commitments to meet. The term ‘Business As Usual' is often applied to this stage of a commercial arrangement, when in truth the reality is that the activities in this phase are typically anything but usual, or what was expected.

Over the last 5 years there has been tremendous change in industry. Several of the ‘first' generation of outsourcing contracts have been re-tendered. Some have seen the incumbent supplier remain insitu, some have seen new suppliers come onboard, some have changed into multi-vendor arrangements, but all have asked for something different from the contract. It is important to remember that just because a deal has been signed it does not mean that the parties can immediately start to deliver the new commitments from Day One and as such the parties need to embark on a period of Transformation. This is a time of peak activity with a significantly higher than usual degree of risk, it is essential you have your contract drafted and managed by experienced practitioners of this key phase. When you are up against the clock, it is not the same as managing a contract in steady-state.
